These Terms of Service (“Terms”) govern your access to and use of the Talkova website, products, and services (collectively, the “Service”) operated by Talkova Inc. (“Talkova,” “we,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Use of the Service
Talkova provides AI-powered voice automation tools for business use. You agree to use the Service in accordance with applicable laws and these Terms, and only for lawful business purposes.
Prohibited Use:
You agree not to use the Service for any unlawful activities, including but not limited to unsolicited marketing, spam, illegal robocalls, harassment, fraud, or activities that violate U.S. telecommunications laws or third-party terms.
2. Account Registration
You may be required to create an account to access certain features. You are responsible for safeguarding your account credentials and all activities that occur under your account.
3. Service Availability
We aim to provide reliable access to the Talkova platform, but we do not guarantee uninterrupted or error-free service. From time to time, the Service may be unavailable due to maintenance, upgrades, system failures, or circumstances beyond our control.
4. Limitation of Liability
To the fullest extent permitted by law, Talkova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of, or inability to access or use, the Service
- Any conduct or content of any third party
- Unauthorized access, use, or alteration of your transmissions or content
No event shall Talkova’s total liability for all claims related to the Service exceed the amount paid by you to Talkova in the twelve (12) months preceding the event giving rise to liability.
5. Force Majeure
Talkova shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to internet outages, technical failures, labor disputes, government actions, war, acts of terrorism, natural disasters, or failures of third-party services or infrastructure.
6. No Warranty
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. Talkova does not guarantee that the Service will be uninterrupted, error-free, or meet your expectations.
7. Data and Privacy
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, process, and protect your data.
8. Termination
We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, if we believe you have violated these Terms.
9. Indemnification
You agree to defend, indemnify, and hold harmless Talkova and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where the services are provided or the user is located, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in such jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the Service or by other means. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
